Important Legal Ruling

Last week the President of the High Court gave judgement in a case, in which Cycling Ireland and a driver in a race cavalcade were, along with other parties, sued by a race participant.

The judge stated that he could not find any evidence of negligence by the defendants or any breach of duty of care by the defendants. The Judge also stated that it does not necessarily follow that there has been negligence when accidents occur involving willing participants in high-risk sports such as boxing or cycling. That is something that should be taken into account by anyone considering taking an action arising out of an injury sustained in a dangerous sport.

The judgement sets an important precedent and provides protection for race organisers or officials against similar future claims.
